Booking Terms & Conditions for Ibiza Villas 2000

  Ibiza Villas 2000 Booking Terms and Conditions are subject to change without notice.

These website terms and conditions constitute the sole record of the agreement between you and The Property Management Company in relation to your use of the website. Neither you nor The Property Management Company shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these website terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and The Property Management Company in respect of your use of the website. The Property Management Company may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

1)     General

 

The contract is between you the person who is renting the Villa and The Property Management Company  (LP Rentals Ltd).

 

2)     Formation of the contract

 

Before making a booking, please contact The Property Management Company  to make sure the Villa is available for the dates required. You must send The Property Management Company  a completed booking form and payment of a non-refundable deposit of 25% of the property rental. A binding contract between the person who has signed the Booking Form and the Property Management Company  will be made when The Property Management Company  issue a confirmation invoice. You are responsible for the payment of the price of the full rental and the compliance of the members of your party with these conditions.

 

Bookings cannot be accepted from persons under 18 years of age at the time of booking. The Property Management Company  reserve the right to refuse a booking without giving a reason.

 

3)     Payment

 

The balance must be paid no later than 10 weeks before departure. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with the paragraph 6. and paragraph 7 below.

 

If you book less than 10 weeks before departure the full balance of the rental is payable at the time of booking.

 

Receipt and banking of any deposit does not constitute acceptance of any booking. A binding contract is made when The Property Management Company  issue a confirmation notice.

 

4)     The Price

 

The prices are in sterling and the rental period is weekly, unless otherwise stated. The Property Management Company  prefer to let for two weeks. A 15% surcharge can be levied on weekly rentals. The Property is let fully furnished and equipped. The price includes linen, and final cleaning services.

 

5)     Security Deposit

 

A security deposit of £600 is required to cover the cost of any damage or breakages and the cost of telephone and other services required i.e the removal of rubbish and extra cleaning if the villa is left in an unacceptable condition. Please ask for details for what is acceptable, also a notice in the villa and on the info pack will posted as to what is acceptable and what is not acceptable. .Should we discover more people staying in the villa than appears on the booking form a surcharge of £250 per additional person will be deducted from the security deposit. Details of your credit card must be given to us, with written authority we may charge your credit card before we issue your travel documents. Alternatively you can provide us with a cheque. The security deposit will be returned to you 5 days after your return less any costs. Delays may be caused while we are waiting to receive telephone and fax bills from Spain. If you pay by credit card this amount will be refunded to your credit card.

   

6)     Alterations or Cancellations

 

In the unlikely event it is necessary to make an alteration or cancel the holiday at the Villa we will inform you as soon as possible, and if requested I will try and arrange alternative holiday accommodation of a similar type and standard and in a similar location to the Villa. If the alternative accommodation is not acceptable we will refund in full all monies paid and shall be under no liability.

   

7)     Cancellation by You

 

Any cancellation by you for whatever reason must be in writing addressed to us at 35 Packington Street, London N1 8QB Telephone: 07769 741 014. Fax: 00 34 971 19 40 18. The effective date of cancellation is the date on which we receive written cancellation.

 

If you cancel 10 weeks or more before departure you will lose your deposit.

 

If you cancel within 10 weeks of departure or if the holiday booking is cancelled due to non-payment we are entitled to full holiday cost from you.

   

8)     Amendments by you

 

Upon receipt of your booking confirmation invoice, please check the details to make sure they are correct. If after your booking has been accepted you require us to amend it in any way or re-invoice you we reserve the right to charge £30 per change.

 

9)   Villa Representation

 

While all the photographs you see and descriptions you read are fundamentally correct, we cannot accept responsibility if minor errors or differences in the photographs / illustrations / text used and the actual property arise.

The Property Management Company  reserve the right to make modifications to the property specification that are considered necessary in the light of operating requirements. In the interest of continued improvements, The Property Management Company  reserve the right to alter furniture, fittings, amenities, facilities, or any activities, either advertised or previously available, without prior notice.

 

If material changes occur after your booking has been made we will advise you if there is time before your departure.

   

10)   Number of People using the Villa

 

Only those persons named on the booking form may use the property without prior arrangement. The number of people staying at the property must not exceed the number of sleeping places indicated in the advertised material, except in the case of infants under two years of ages or written consent from The Property Management Company .  The Property Owner and the manager reserves the right to revoke the booking at their sole discretion. This means should we discover more people in the villa than appears on the booking form we have the right to cancel the booking and evict the group immediately or apply a surcharge payable immediately.

 

11)   Access

 

The Property Management Company or his/her representative shall be allowed free access to the Villa, owned by The Property Management Company  (Luke Peppe and Michelle Rikh) at any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.

 

12)   Arrival and Departure

 

You must arrive after 16:00 on the holiday start date, and the accommodation must be vacated by 10:00 on the last day unless otherwise specified by the Property Management Company  in writing. If these times are difficult please advise when you are booking. If your arrival is delayed please inform the Property Management Company  so that suitable arrangements can be made for entry to the Villa. If you arrive after 22:00 you may not be able to occupy the property until the next day.

 

13)   Pets

 

Pets are not allowed without prior written permission of the Property Owner. You may be asked for an additional security deposit.

 

14)   Your Responsibilities

 

You must keep the Villa (holiday accommodation) and all furniture, fittings effects, facilities and equipment in the same state of repair and condition as at the commencement of your holiday or stay. You must leave the Villa (the holiday accommodation) in the same state of cleanliness and general order in which you found it. You are responsible for all damage or loss which occurs to the property or its contents during your occupation and will be responsible for paying appropriate compensation to The Property Management Company  in the event of breakages or damage.

 

15)   Complaints

 

In the unlikely event that you are disappointed with the Villa, you must contact the Property Management Company  or local representative who will try to solve the problem. If after that you feel that the problems were not sorted out to your satisfaction please write to the Property Management Company  within seven days of returning from your holiday at the Villa. If you vacate the property before the end of your rental period without our authorisation you shall lose any rights to compensation.

 

16)   Liability of us, The Property Management Company

 

We shall not be responsible for the death of or personal injury of you or your or any person named on the booking form or other person at the property unless this results from the proven negligence of the Property Management Company .

 

We shall not be responsible for any loss, breach or delay beyond our reasonable control, including though, but not limited to, act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of governmental or local authority, strikes. Lockouts, or other industrial actions or disputes or adverse weather conditions. In any such case we shall be entitled to treat the contract as discharged.

 

In the event of such a discharge our liability shall be limited to the return of the sums paid to us in respect of the unused portion of the rental calculated on a pro rata daily basis less an administrative charge of £20.00 to cover our reasonable expenses.

 

We cannot be held responsible for the breakdown of mechanical equipment, such as pumps, boilers, swimming pool filtration systems etc, nor for failure of public utilities such as water, electricity and gas. Or for any water wells feeding the Villa.

 

We are not responsible for noise and disturbance originating beyond the boundaries of the Villa or anything which is beyond our control.

 

17)   Cleaning

 

The property will be cleaned throughout at the beginning of the rental period and you must leave it clean throughout and at the end of the rental period.

 

18)   Behaviour

 

The person signing the contract is responsible for the correct and decent behaviour of his / her party. Should you and your party not behave in a manner the key holder, Property Management Company  or Local Representative at his / her absolute discretion ask you and your party to vacate the property without any refund in the price.

 

19)   Staff

 

Cleaning staff is included as outlined in paragraph 17. Additional staff could be included for an extra cost. Please give us as much notice as possible, but we cannot guarantee success. We accept no responsibility for additional staff or services. Any other arrangements you make between your staff or any other person or company providing services when you are at the Villa, are between you and your staff and we accept no responsibility for these services service provided and the terms on which they are provided.

   

20)   Linen

 

Linen is included in the Villa , but it is advisable to take your own beach towels and cot linen. Linen is normally changed once per week. If you require more frequent changes there will be an extra charge.

 

21)   Swimming Pools

 

The Swimming Pool will usually be closed in the winter months. If the rental falls within this period please check with us if the pool is open. If pool heating is available this is an extra charge.

 

22)   Photographs

 

Photographs taken at the Villa cannot be sold for profit without the permission of The Property Management Company .

 

23)   Social Events

 

It is the policy of the Property Management Company  not to allow social events and other functions (e.g. weddings, receptions, large cocktail parties) on the property without prior agreement with us, the Property Management Company . Permission will be required for any event where more than twice the number of people the property is advertised as accommodating (including the holiday party itself). If permission is granted an additional fee may be charged.

 

24)   Security and Valuables

 

Any valuables left at the property are at your own risk. The Property Management Company , local representative or agents are not responsible for your loss. As with all rental property in prime locations, there is a risk of burglary. The burglar alarms and any security must be activated. It is your responsibility to advise the Property Management Company  immediately on arrival if any of the security systems does not work. The property owner will take all reasonable steps to correct any fault but we cannot guarantee to fix the fault during your rental. We accept no responsibility for any loss, damage or consequential losses due to theft or any security related incident however caused.

   

25)   Insurance

 

It is a condition of booking that your party is covered by comprehensive travel insurance.

 

26)   Problems and Faults

 

Please note: Any problems and faults in the villa, even matters concerning light bulb failure, should be reported to the local representative within a reasonable period of time. For instance 24 hours.

   

27)   Rubbish disposal

 

It is your responsibility to remove daily rubbish in black bags from the premises. Failure to do so will result in the rubbish being removed by the local representative. A charge of 40 Euro's per bag will be made for this service.

 

28)   Law

 

All contractual obligations arising out of these booking conditions shall be deemed to come into existence in Shoreham by Sea, West Sussex and be subject to British Law and the exclusive jurisdiction of the British Courts.
